Jobs that you can’t source Vietnamese workers to work abroad

In Vietnam, the government has established specific regulations to protect its workforce and uphold national interests when it comes to labor export. Certain industries and occupations are strictly prohibited from sending Vietnamese workers abroad. It’s crucial to understand these restrictions for employers aiming to recruit Vietnamese workers. Prohibited Occupations for Vietnamese Workers Abroad

According to the Law on Vietnamese Guest Workers 2020, effective from January 1, 2022, the following occupations are prohibited for Vietnamese labor export:

  1. Massage Staff in Entertainment Venues: Positions involving massage services in restaurants, hotels, or amusement parks are banned. This is also the position that many employers have been asking Vietnam Manpower Group to source. However, because of the regulation restriction, we can’t not source Vietnamese workers for this positions. 

  2. Exposure to Hazardous Substances: Jobs requiring regular contact with explosives or toxic substances in metal works (such as copper, lead, mercury, silver, zinc), manganese dioxide, or mercury are prohibited.

  3. Radiation-Related Professions: Occupations involving exposure to radiation sources or the extraction of radioactive ores are restricted.

  4. Handling Toxic Chemicals: Manufacturing and packaging roles that involve regular contact with substances like nitric acid, sodium sulfate, carbon disulfide, pesticides, herbicides, rodenticides, antiseptics, and highly toxic insecticides are banned.

  5. Dangerous Animal Hunting: Professions that include hunting dangerous animals such as crocodiles or sharks are prohibited.

  6. Work in Extreme Environments: Jobs requiring regular stays in low-oxygen or high-pressure environments, such as underground or seabed operations, are restricted.

  7. Funeral Services: Occupations involving shrouding, cremating, or bone collecting are prohibited.

Additional Prohibited Acts in Labor Export

Beyond specific occupations, the Vietnamese government also prohibits the following actions related to labor export:

  • Deception and Exploitation: Manipulating, inciting, or deceiving workers; exploiting labor export services for illegal activities such as human trafficking or labor abuse.

  • Unauthorized Procedures: Assisting or acting on behalf of workers to follow procedures for working abroad without the consent of competent authorities.

  • Coercion: Forcing or tricking Vietnamese workers to stay abroad against their will.

  • Discrimination and Abuse: Discriminating against, humiliating, or abusing workers in matters related to labor export.

  • Unauthorized Service Provision: Providing labor export services without a license or using another enterprise’s license.

  • Violation of National Security: Engaging in labor export activities that violate national security, social safety, or social morality.

These regulations are designed to protect Vietnamese workers from exploitation and hazardous working conditions while maintaining the country’s ethical standards and international reputation. Both workers and employers must adhere to these laws to ensure safe and legal labor export practices.
